Affiliate Program Terms

1. Eligibility

You must be 18 years or older to participate in the NutriBalance Affiliate Program. By applying, you confirm that you have the legal capacity to enter into this agreement. There is no minimum follower count required.

2. How It Works

Upon approval, you receive a unique promo code. When a new user subscribes to NutriBalance Premium using your code, you earn a one-time commission of A$6 (CPA — cost per acquisition). This is a one-time bounty per unique new subscriber, not a recurring revenue share.

Your followers receive a permanently discounted subscription price while your code remains active.

3. FTC Disclosure Requirements (Required)

You must clearly and conspicuously disclose your affiliate relationship with NutriBalance in every piece of promotional content, including but not limited to social media posts, videos, stories, blog articles, and emails.

• Use clear language such as #ad, #sponsored, #affiliate, or "I earn a commission from this link" at the beginning of any caption or description — not buried at the end.
• Disclosures must be visible without the viewer needing to click "more" or expand text.
• These requirements apply across all platforms: Instagram, TikTok, YouTube, Reddit, Twitter/X, Facebook, blogs, and newsletters.
• Failure to disclose may result in immediate termination of your affiliate account and forfeiture of unpaid commissions.

These requirements are based on the FTC Endorsement Guides. NutriBalance is not responsible for any regulatory action taken against you for failure to comply.

4. Prohibited Conduct

You may not:

• Make false, misleading, or unsubstantiated claims about NutriBalance's features or health benefits.
• Claim medical or therapeutic benefits not stated in NutriBalance's official materials.
• Use spam, unsolicited messages, or deceptive advertising practices to promote your code.
• Bid on NutriBalance brand terms in paid search advertising without prior written approval.
• Self-refer (use your own promo code to subscribe) or refer bots, fake accounts, or fraudulent sign-ups.
• Share your promo code on coupon aggregator sites without prior written approval.
• Impersonate NutriBalance or claim to be an official representative.

5. Health & Nutrition Claims

NutriBalance is a general nutrition tracking tool. It is not a medical device and does not provide medical advice. When promoting NutriBalance, you must not make specific health, medical, or therapeutic claims (e.g., "this app cured my condition" or "this app is medically prescribed"). General fitness and nutrition tracking benefits are acceptable.

6. Payouts

Commissions are paid automatically via Stripe to the bank account you connect during onboarding. Payouts require you to complete Stripe's identity verification. NutriBalance is not responsible for delays caused by incomplete Stripe onboarding or incorrect banking details.

NutriBalance reserves the right to withhold payment if fraud is suspected, pending investigation. Commissions earned through fraudulent referrals will be forfeited.

You are responsible for reporting affiliate income to relevant tax authorities in your jurisdiction. NutriBalance may issue tax forms as required by applicable law.

7. Brand Usage

You may use NutriBalance's name, logo, and approved marketing materials solely for the purpose of promoting the affiliate program. You may not modify the logo, use it in a way that implies endorsement beyond the affiliate relationship, or register domain names that include "NutriBalance" without written permission.

8. Term & Termination

This agreement begins when you apply and is accepted by NutriBalance. Either party may terminate this agreement at any time for any reason with no notice required. NutriBalance may terminate your account immediately for violation of these terms, fraudulent activity, or conduct that harms NutriBalance's reputation.

Upon termination, you will receive payment for any valid commissions earned before the termination date, subject to a 30-day review period for fraud assessment.

9. Modifications

NutriBalance reserves the right to modify these terms at any time. Continued use of your affiliate account after changes are posted constitutes acceptance of the updated terms. Material changes will be communicated via email.

10. Limitation of Liability

NutriBalance's total liability to you under this program shall not exceed the commissions paid to you in the 90 days prior to any claim. NutriBalance is not liable for indirect, incidental, or consequential damages arising from your participation in the program.

11. Governing Law

These terms are governed by the laws of Queensland, Australia. Any disputes shall be resolved in the courts of Queensland, Australia.
